Article 81 is one of the most important employee-protection articles in the Saudi Labor Law. It deals with situations where a worker may leave the job without giving notice while still keeping statutory rights.

What does Article 81 mean?

In simple HR language, Article 81 applies when the employer’s conduct or failure is serious enough that the worker should not be forced to continue working or serve a notice period.

Main cases commonly linked to Article 81

1. Employer fails essential contractual or statutory obligations

This may include serious failure to meet essential obligations under the employment contract or Saudi Labor Law. HR teams should document obligations clearly and respond to complaints quickly.

2. Fraud at the time of contracting

If the employer or representative used fraud regarding working conditions or circumstances at the time of contracting, Article 81 may become relevant.

3. Assignment to substantially different work without consent

If the worker is assigned to work that is fundamentally different from the agreed work without consent, this can create a dispute. HR should document role changes and obtain proper agreement.

4. Assault, immoral conduct, cruelty or insult

Serious misconduct by the employer, manager, or representative against the worker can be connected to Article 81. HR should investigate workplace complaints immediately and keep records.

5. Serious workplace safety or health danger

If there is a serious danger threatening the worker’s safety or health and the employer is aware but does not take proper action, Article 81 may be relevant.

6. Employer actions forcing the worker to appear as the one ending the contract

Article 81 also covers situations where the employer’s actions or treatment are intended to make the worker appear as if they ended the contract themselves.
